WE FINALLY UNDERSTAND HOW THE US VIEWS AI COPYRIGHT CLAIMS
Weeks ago, we mentioned Kristina Kashtanova and her graphic novel, “Zarya of the Dawn.” Remember, Midjourney composed all the panels in their work.
The US Copyright Office reviewed that claim and clarified what Kashtanova could and could not license. Here’s how it played out:
1/ They own the right’s to the story they wrote. It was original work done by Kashtanova.
2/ They can copyright the graphic novel’s arrangement of the panels. In other words, they own how they structured and assembled the story.
3/ Here’s the big one: They do not own any images made with Midjourney. So the office says Kashtanova must resubmit their claim with that part omitted.
So, Do We Not Own the AI Images that We Generate?
The office implies that’s the case. The images are not the product of “human authorship” and not something one can copyright.
That means they consider every image I make for these newsletters a part of the public domain.
The Supreme Court decided long ago that works of authorship are limited to human authors. Granted, they didn’t even know what a laptop was back then, but…
¯\_(ツ)_/¯.
Oddly enough, Midjourney’s general counsel considers this announcement a victory, and I see their point. You can use AI images as a part of your whole work and keep ownership of that creation.
It’s a mixed bag, in my opinion. We’re all free to create books, comics, games, films, etc., all with the help of AI, but the prompt itself is free game.
How long until we all get used to generative AI and recognize the skill it takes to get an image the way you want it to look?

HOW MUCH DO YOU TRUST AI TO DIAGNOSE AND TREAT YOUR ILLNESSES?
The Pew Research Center found that 60% of Americans feel uncomfortable with their healthcare provider relying on AI.
This outcome is strange, considering the FDA cleared 500 AI algorithms for healthcare as of January. In fact, one of the most significant issues people had in the survey was the speed of adoption.
The system is moving at ludicrous speed, and the general public is Dark Helmet holding on for dear life.
What’s with the Disconnect?
Tons of exciting new ways for AI to diagnose diseases are released weekly. Healthcare, as an industry, is adopting new artificial intelligence and machine learning tech at an exponential rate. No one wants to be left behind.
One word can sum up the actual concern patients have: care.
Most respondents believe that AI is accurate and that they can trust treatment plans made by a learning model. In addition, there was clear support for AI’s ability to eliminate bias in health services.
The issue is relationships. Going to the doctor is scary. Do you trust AI to have good bedside manners?
The idea of a doctor’s attention for you diminishing is an unwelcome thought right now.
Ultimately, the adoption and advancement of AI in the medical field will continue to compound. That’s a good thing.
Your doctor will see and hear from you like normal, but I am willing to bet your visits will improve with AI’s help.
Physicians will avoid burnout and longer hours. Instead, they can focus on going deeper into the data and crafting the best treatment for every patient.
AI is like Allstate. You’re in good hands.
